Military Disciplinary Administrative Process and Procedure: Need to expand the heads of investigation and preliminary investigative procedure within the scope of the Military Police of the State of Tocantins

Abstract

The present scientific work aims to analyze the disciplinary administrative processes and procedures, with emphasis on what happens within the scope of the Military Police of the State of Tocantins - PMTO, with a view to expanding the military police in charge (1st perfected Sergeants and Sublieutenants of the combatant staff) Investigation and Preliminary Investigation Procedure – PIP. Pursuant to the Federal Constitution of 1988, the administrative disciplinary process is mandatory for investigation of conduct and possible application of penalties. Thus, in the State of Tocantins, through Law n. 2578 (2012), as well as by Decree n. 4994 (2014), which deal with administrative processes to investigate the conduct of state military members. In addition to Normative Instruction No. 001/2014 – Office of the General Commander that instituted the PIP in PMTO. It is noteworthy that administrative disciplinary processes in the military sphere are important for the maintenance of hierarchy and discipline, as it is the basis of Brazilian military institutions. The importance of the PIP, on the other hand, is to investigate the facts that do not have sufficient evidence for the establishment of an Inquiry. In the work methodology, applied, descriptive, bibliographical and documentary research was used, using the hypothetical-deductive method and carried out a qualitative approach. In the end, it was concluded that there is a legal possibility for the aforementioned graduates in the scope of the PMTO to be in charge of investigation and PIP, as long as there is a change in the rules.

Philipe Lira de Carvalho, Polícia Militar do Estado do Tocantins

Master in Public Policy Management from the Federal University of Tocantins-UFT Foundation. He holds a law degree from UFT (2008) and a degree in Public Security from the Tiradentes Military Police Academy (2008). Specialization in Public Management (420 hours) by the Faculty of Londrina - Paraná and Specialization in Higher Education Teaching by the Faculty of Applied Social Sciences of Marabá - Facimab (360 hours). He is currently studying Pedagogy, as well as a Specialization in School Supervision at Instituto Coimbra. He is currently Major QOPM of the Military Police of the State of Tocantins and Commander of the 1st CIPM. He has experience in the area of ​​public policy, law, extensive knowledge in operational and administrative service fronts, including: Deputy Commander of the Military Police Unit - UPM, Commander of UPM, Inspector of UPM, Legal Adviser of the Inspector General and the Legal Counsel of PMTO. He is a professor at the Tiradentes Military Police Academy, teaching in subjects of Community Police, Didactics, Processes and Procedures, Organizational Legislation, Human Rights, People Management and Leadership and also as a professor of Mathematics, Notions of Administrative Law, Constitutional and Federal Legislation and State in courses.

Frank Cynatra Sousa Melo, Polícia Militar do Estado do Tocantins

Specialist (Lato Sensu Post-Graduation) in Legal Sciences completed at Cruzeiro do Sul University (2019). Bachelor's Degree in Public Security (Officer Training Course) carried out by the Tocantins Military Police (PMTO) in partnership with the State University of Tocantins (UNITINS, 2005-2008). He studied law at UNITINS (2017). Completed the Bachelor's Degree in Law at Universidade Cruzeiro do Sul (UNICSUL - 2020). Completed the Official Improvement Course developed by PMTO (CFO - 2019). Completed the Improvement Course in Human Law developed by the Metropolitan College of the State of São Paulo (2021). Postgraduate in Military Judiciary Police at Faculdade Metropolitana São Carlos (FAMESC-2021). Postgraduate in Higher Education Teaching at Faculdade Metropolitana São Carlos (FAMESC-2021). Superior Combatant Officer (MAJOR QOPM) of the Tocantins State Military Police. For several years, he performed Command functions in the PMTO scope (Platoon Commander, Company Commander and Battalion Sub-Commander). He served as a member of the Permanent Council of Military Justice of the State of Tocantins in the role of Military Judge (year - 2019/2020). Taught classes related to the discipline of Physical Sciences at CEFET/IFMA (1999-2000). Conceived and acted as a Teacher of the Popular Educational Course at PMTO in the area of ​​the 3rd Company/9th BPM (2016-2017 - Bico do Papagaio). Acted as Instructor/Manager of the Drawing up of Detailed Term of Occurrence at PMTO in Palmas/TO (2019). Has the Life Preservation Defensive Shooting Multiplier Course (Giraldi Method) developed by PMTO (2008). He was the Class Coordinator of the PMTO Sergeant Improvement Course (2020-2021). He is currently Instructor of the Institutional Legislation Discipline of the Qualification Course for Officials of Administration, Health and Musicians at PMTO (2021) and Coordinator of the aforementioned courses. Allotted to the Teaching Unit of the PMTO (Tiradentes Military Police Academy - APMT). Has experience in Law, Education and Public Security. He has a strong presence in the subjects of Mathematical Sciences, Physical Sciences, Criminal Law and Criminal Procedural Law.
